Republicans Demand Another Vote to Repeal the Affordable Care Act

“Why did Obamacare fail? Obamacare was rammed through with Democrats’ votes only,” he said on CBS’s “Face the Nation” on Sunday. […]

Trump Confirms Support for Law to Protect ‘Dreamers’

Republican leaders were contacted after the fact. In a curt statement, Senator Mitch McConnell of Kentucky, the majority leader, confirmed that the president called him Thursday morning to discuss immigration issues.“As Congress debates the best ways to address illegal immigration through strong border security and interior enforcement, DACA should be part of those discussions. We look forward to receiving the Trump administration’s legislative proposal as we continue our work on these issues,” he said.At this point, any legislative proposal appears to be coming from the minority party. A senior Democratic official familiar with Wednesday’s dinner conversation said the agreement was specific, drawing on language from Mr. […]

Senate Rejects Bipartisan Effort to End 9/11 Military Force Declaration

But so far Congress has balked, declining to take on the difficult issue even as lawmakers such as Mr. Kaine insist that the legislative branch should reclaim its constitutional duty to declare war.In the House, in another unlikely partnership, Representative Barbara Lee, the California Democrat who was the only member of the House to vote against the original resolution in 2001, paired up with Representative Scott Taylor, a freshman Virginia Republican and former Navy SEAL, over the summer to convince the Appropriations Committee to insert language repealing the original use of force declaration into a spending bill.“I just felt compelled to stand up and say, now it’s time to look at the AUMF,” Mr. Taylor said, using the acronym for the authorization for the use of military force. He said once he spoke up, other Republicans joined in to support him: “It’s an issue that I don’t think is going to go away.”But Republican leaders stripped the provision out of the spending measure; Speaker Paul D. Ryan said at the time that the move was a “mistake” and that such language was not appropriate for inclusion in a spending measure.“It was really shameful,” Ms. […]

Trump to Travel to Texas With Torrential Rain Still in the Forecast

Mr. Trump also used the hurricane to soft-pedal a bit of unrelated political business, announcing late on Friday night that he had pardoned Joe Arpaio, the former Arizona sheriff. The timing seemed anything but coincidental: With cable news channels switching to wall-to-wall storm coverage, the fierce criticism of Mr. Trump’s action, from Republicans as well as Democrats, was largely lost in the howling winds. There were other off-key moments throughout the weekend. At times, Mr. Trump’s tweets conveyed an unabashed excitement about the historic nature of the storm, even as it became clear that Houston and other cities faced a grinding crisis.“Wow,” he tweeted on Sunday morning. “Now experts are calling #Harvey a once in 500 year flood! We have an all out effort going, and going well!” An hour earlier, he noted, “Many people are now saying that this is the worst storm/hurricane they have ever seen […]

As White Nationalist in Charlottesville Fired, Police ‘Never Moved’

Officials have insisted that no “stand down” order was issued, and a state police spokeswoman said troopers did not hear the shot. But many people suspect the inaction was deliberate, because just a month earlier, the police were heavily criticized for responding harshly at a Ku Klux Klan rally where anti-Klan protesters were sprayed with tear gas and arrested. On the day of the “Unite the Right” rally, Aug. 12, only eight arrests were made, even with 125 local officers, hundreds of National Guard troops, the state police and neighboring police agencies present. Those arrested included James A. Fields, the driver who has been charged with murder in the death of Heather D. Heyer.Investigators are also close to making arrests in the case of DeAndre Harris, 20, a local teacher’s aide and African-American who was beaten with a metal pipe and slabs of wood in a parking garage just a few yards from Police Headquarters, the city manager, Maurice Jones, said. The police chief and mayor declined requests to be interviewed.Mr. Jones said the police had developed two “tactical mobile force contingency plans” that were to be used as “quick responders” to skirmishes and fights that were popping up throughout downtown. The officers were instructed to “respond to fights directly” and to make arrests in teams and squads, he said.“We saw plenty of video of officers stepping in to de-escalate situations,” Mr. Jones said.He stressed that the city had tried to prevent the rally, but that a federal judge had ordered the city to grant the permit. But even a member of the City Council asked the city manager and the police chief why there was an “apparent unwillingness of officers to directly intervene during overt assaults.”The city did not use a number of security measures recommended by the state police, said Brian Moran, Virginia’s secretary of public safety and homeland security, including a ban on weapons and sticks of all kinds. Why Trump’s Pardon of Arpaio Follows Law, Yet Challenges It

“Arpaio didn’t just violate a law passed by Congress,” Professor Feldman wrote on Bloomberg View. “His actions defied the Constitution itself, the bedrock of the entire system of government.” By saying Mr. Arpaio’s offense was forgivable, Professor Feldman added, Mr. Trump threatens “the very structure on which his right to pardon is based.”It was the first act of outright defiance against the judiciary by a president who has not been shy about criticizing federal judges who ruled against his businesses and policies. But while the move may have been unusual, there is nothing in the text of the Constitution’s pardons clause to suggest that he exceeded his authority. The president, the clause says, “shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment.”The pardon power extends only to federal crimes. Otherwise, presidents are free to use it as they see fit. As the Supreme Court put it in an 1866 decision involving a former Confederate senator, Ex Parte Garland, the power “is unlimited.”“It extends,” the court said, “to every offense known to the law.”In a tweet last month, Mr. Trump indicated that he had studied the matter in the context of the investigation of ties between the Trump campaign and Russia. “All agree the U.S. […]
