Head-Spinning Days for Young Immigrants as Lawmakers and Judges Debate Their Fate

Hafsa Mamun, 18, spends about 30 minutes a night scrolling through news stories about the negotiations after she gets home from classes at Hunter College in Manhattan, where she is a freshman. Born in Malawi to Indian parents and brought to the United States as a 5-year-old, Ms. Mamun’s protected status expires in 2019. She said she had not made any plans about the future because things were so uncertain.“It’s like you’re on edge constantly,” she said. “One day you have hope that it might go through, and then something else comes up.”PhotoKevin Vazquez, center, was one of a group of young immigrants visiting Congress this week to urge them to reach a deal.Credit Tom Brenner/The New York TimesAn agreement did seem to be staggering closer on Tuesday, though how much closer seemed impossible for even the negotiators to predict amid the welter of bewildering signals from Mr. Trump. After a year of holding a hard line on immigration, the president suggested in a meeting with congressional leaders that he supported not only a deal to protect the Dreamers but also a comprehensive immigration reform package, raising the possibility that the DACA recipients’ security could hinge on a much messier set of compromises.Republicans, meanwhile, were still pushing to tie any benefits for the young immigrants to curbs on family-based legal immigration, border security and other conservative priorities that Democrats and immigration advocates have frowned upon.“We’re being held hostage as a bargaining chip,” said Rafael Robles, 26, a DACA recipient in Chicago who owns an architecture, design and real estate development firm. The Las Vegas Gunman Was Rich. Will His Wealth Go to the Victims?

So far, several hundred victims have filed more than two dozen lawsuits, and a $45 million creditor’s claim, against Mr. Paddock’s estate; MGM Resorts International, which owns the Mandalay Bay; and Live Nation, the promoter of the festival. Should plaintiffs agree not to pursue their lawsuits against the Paddock estate, a complicated and potentially contentious issue will involve establishing criteria for who is eligible for payouts from the estate and how much. While payouts to victims of mass shootings have become standard practice, turning a dead perpetrator’s estate into a fund for such a large number of victims is new territory.“There is no precedent here,” said Alice Denton, a Nevada lawyer who is leading the effort to have Mr. Paddock’s estate apportioned among victims to help cover expenses like medical bills.Ms. Denton, who represents five victims, added, “Most mass killers have been indigent or had modest assets or none to speak of.”That was the case, for instance, with Omar Mateen, who fatally shot 49 people and wounded dozens of others at the Pulse nightclub in Orlando, Fla., in June of last year. A victims fund for that shooting handed out $32 million. In 2011, the federal government auctioned off some of the belongings of Theodore J. Kaczynski, known as the Unabomber, to provide some restitution to his victims and their families. He killed three people and wounded 28 others in a mail-bomb campaign that spanned 17 years before he was arrested in 1996.Photo” data-mediaviewer-credit=”Hilary Swift for The New York Times” itemprop=”url” itemid=”https://static01.nyt.com/images/2017/12/13/us/00paddockmoney-02/merlin_128309192_39f80b7e-2147-48a8-949d-bc7938a04dd0-master675.jpg”/>A memorial to victims of the shooting on the Las Vegas strip. Siding With Trump, Judge Clears Way for Trial Over Health Subsidies

The subsidies reimburse insurers for reducing deductibles, co-payments and other out-of-pocket costs for seven million low-income people who buy midlevel silver plans on the Affordable Care Act marketplace. Under the law, insurers will still have to provide the discounts, known as cost-sharing reductions, but may be unable to collect reimbursement from the government.Mr. Trump ordered federal officials two weeks ago to stop making the monthly payments. Another federal district judge, in Washington, ruled in 2016 that the payments were unconstitutional because Congress had never appropriated money for them.On Wednesday, Judge Chhabria concluded that “both sides have reasonable arguments’’ on the main legal question: Whether Congress appropriated money for the cost-sharing payments. Two senior senators, Lamar Alexander of Tennessee, a Republican, and Patty Murray of Washington, a Democrat, announced last week that they had agreed on a bill to extend the cost-sharing payments through 2019 and make it easier for states to obtain waivers from requirements of the Affordable Care Act. After initially endorsing the deal, Mr. Trump backed off a day later, and the White House demanded changes as a condition of its support. The Congressional Budget Office said Wednesday that the Alexander-Murray bill would produce a modest reduction in federal budget deficits, but would not substantially change the number of people with coverage. The budget office estimated that the legislation would reduce deficits by a total of $3.8 billion over the next decade. With the deficit for the last fiscal year alone reaching $666 billion, that is a relatively small number, but supporters of the bill made the most of it.“The Congressional Budget Office has found that our proposal benefits taxpayers, it benefits consumers — not insurance companies,” said Mr. Alexander, the chairman of the Senate health committee.Continue reading the main storyThe proposal has broad support from Democratic senators and at least a dozen Republican senators […]

Article 155: The ‘Nuclear Option’ That Could Let Spain Seize Catalonia

The article allows the government to intervene in one of Spain’s regions if its autonomous government “fails to fulfill the obligations imposed upon it by the Constitution or other laws, or acts in a way seriously prejudicing the general interests of Spain.”It is such a broad instrument that its use has been considered only once before, in 1989, when Felipe González, the Socialist prime minister, threatened to wield it against the Canary Islands to force it to comply with tax obligations. The second part of Article 155 calls upon the government to “issue instructions” to restore constitutional order, which is why legal experts are also now debating how Mr. Rajoy’s government could use Article 155 to seize back power in Catalonia if faced with a full-blown insurrection.Given the lack of precedent, however, Mr. Rajoy starts with a blank canvas. He could make Article 155 as broad or narrow as he wishes, as well as keep its measures in place for as long as he deems necessary. One option may be to use it to suspend from office Catalonia’s political leadership, starting with Mr. Puigdemont, but also including other lawmakers and to dissolve the Catalan Parliament to force early elections.Mr. Rajoy and his government could also suspend other Catalan officials across the region’s public administration, from the leadership of the Catalan autonomous police force to the directorship of the Catalan public television and radio broadcaster. How quickly will Article 155 be used?Following his cabinet meeting, Mr. Rajoy must follow a parliamentary procedure that culminates in a plenary vote in the Senate. Las Vegas Gunman Chased Gambling’s Payouts and Perks

That the attack was launched from a glassy tower of one of Las Vegas’s most prestigious casinos was not a coincidence. A defining aspect of Mr. Paddock’s life involved gambling, and he hungered for the kinds of rewards that only the Las Vegas Strip could provide.Just three days before he opened fire from the Mandalay Bay, he was seen playing video poker in its casino.Mr […]
